TERMS AND CONDITIONS
The following terms and conditions apply to Pedal for Scotland 2017 event (“the Event”).
The promoter of the Event is Cycling Scotland (“the Organiser”), [24 Blythswood Square, Glasgow, G2 4BG].
By registering for the Event, entrants agree to be bound by the following terms and conditions and any and all other associated promotional materials published by the Organiser.
- REGISTRATION
- Registrations for the Event open on Sunday 11 September 2016 (the “Opening Date”) and will open up until the event day Individuals must be 10 years old to take part in the Classic Challenge; 16 years old to take part in the Big Belter and five (5) years old for the Wee Jaunt events. All participants under the age of 18 will need a parent or guardian to register on their behalf and sign the terms and conditions. Proof of identity and age may be required at the start of the Event.
- Children younger than 5 can participate in the Falkirk and/or Perth Wee Jaunt on bike seats, tag-alongs or trailers.
- Entries are on a first come, first served basis.
- In order to register for the Event, all participants must apply by:
- Visiting pedalforscotland.org (the “Website); and
- Completing all requested information
- Accepting the terms and conditions of the Event by ticking the relevant field in the online registration form
- Making relevant payment by approved debit or credit card
- Once registered, the participant will receive confirmation by email that they have a confirmed place for the Event. In the case of anyone under the age of 18, the registration form must be completed by a parent or guardian, who will also confirm his/her acceptance of the terms and conditions of participating in the Event.
- If payment cannot be collected for any reason including, without limitation, insufficient funds, cover of account or revocation by the applicant (including at a later date), the applicant cannot participate in the Event.
- If an entry is accepted, the entry is non-refundable.
- Once registered, each participant will be allocated an official event number for the Event. Registration of an individual cannot be transferred to another individual.
- A participant may withdraw from the Event at any time but the entry will not be refunded.
- Once registered a participant may not defer their entry to the following year, nor to any other event.
- Upon receipt of an event bib each participant will state in a binding manner that they are free of any health conditions which may affect their participation in the Event. The participant must complete the medical information on the reverse of their Event bib, prior to taking part in the Event.
- Participation in the Event is not guaranteed and is subject to availability and individual assessment.
- Entries not in accordance with these Terms and Conditions are invalid.
- THE EVENT
- For the Classic Challenge (and Gold), Big Belter (and Gold) an event pack will be posted to the participant in advance of the Events on Sunday 10 September by Tuesday 5 September 2017and will be available on the day for the Wee Jaunt Falkirk and Perth. Registration and event pack collection will only be available on Sunday 10 September for late registrations and if a participant has not received a pack in the post.
- If at any time the Organiser discovers that a participant is ineligible to participate in the Event, the Organiser reserves the right to remove that participant and/or refuse the participant entry into the Event, without any refund of the entry.
- Has, or is likely, to affect the safety of other participants;
- Uses threatening, abusive or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace;
- In the reasonable opinion of the Organiser is acting under the influence of alcohol or drugs
- The Organiser hold sole and absolute discretion in this regard and their decision will be final.
- The Organiser reserves the right to remove any participant from the Event, either during or before it, due to ill health, or any other reason (at the Organiser’s discretion) that may render him/her unfit to safely complete the Event. The participant confirms that he/she will not take part in the Event if he/she is suffering from any contagious illness and confirms that he/she will immediately report any illness during the Event, to the Event medical team.
- Any participant that fails or refuses to comply with these terms and conditions may be removed from the Event by the Organiser. Any such decision will be at the sole and absolute discretion of either of the Organiser and will be final.
- In order to ensure the roads are clear for re-opening to traffic, the Organiser has the right to remove from the event any participant who does not meet the required cut-off time as dictated by the sweep vehicle. The required finish time for the Classic Challenge and Big Belter rides is sent to participants in the rider information booklet plus included on the website before the event. No refunds will be paid to participants in these cases.
- If the Event is cancelled because of circumstances beyond the reasonable control of the Organiser including, without limitation, fire, storm and/or flood, earthquake, explosion, acts of a public enemy, war, insurrection, terrorist act or threat of terrorist act, sabotage, epidemic, embargoes, strikes, or the death of a leading member of the British Royal Family (“Force Majeure”), then the participant will not be entitled to any refund of the entry and compensation of other losses, such as travelling or accommodation expenses.
- Any participant who fails to arrive at the start of the Event will not be entitled to any refund.
- The Organiser reserves the right to alter the start time of the Event. In this situation, participants will be notified of the revised start time with as much notice as possible. No refund in full or in part shall be made for any change in start time for the Event provided the Event takes place on the advertised date of 7th May 2017 for Wee Jaunt Falkirk, 6th August 2017 for Wee Jaunt Perth or 10th September 2017 for the Classic Challenge, Big Belter and Wee Jaunt Edinburgh.
- The Organiser reserves the right to change the date of the Event. If the participant is unable to attend on the revised date, he/she has 14 days to inform the Organiser in writing from when the change in date is announced, in order to receive a refund of his/her entry.
- The Organiser reserves the right to amend the Event format, including changing the course and the distance, at their sole discretion. If the Event format, course or distance is changed, the participant will not be entitled to any refund and there shall be no further liability whatsoever arising from such change of format, course or distance.
- The Organiser will not be liable for any actions of any spectators or other third parties.
- The participant accepts that any mechanical support received on his/her bike from the Organiser, partners, other participants or third parties is at his/her own discretion and the participant will not hold anyone else responsible for any subsequent bike malfunctions or resulting injury.
- The participant accepts that should his/her bike be transferred in any vehicle during the event, such as the sweep vehicle, he/she accepts it is placed and transferred in the vehicle at his/her own risk and the Organiser is not liable for any damage caused during this process.
- Some of the food products given out on Event day may contain or have traces of nuts and nut oils or may have been made alongside other products containing nuts. The Organiser cannot be held responsible for any issues resulting from nut or other food allergies.
As a continuing condition of entry each participant shall ensure, for the duration of the Event, that they:
- Wearing a safety approved cycle helmet, conforming to British Cycling standards, is strongly recommended;
- Should be capable of carrying out basic bike maintenance, such as puncture repairs, whilst on the route;
- Do not start earlier than the official start time on each day of the Event. Failure to comply with this rule will result in removal;
- Ensure their bicycle is roadworthy for the Event;
- Do not use a mobile phone whilst cycling;
- Do not bring or use a drone whilst on the event or as a spectator
- Adhere to advice provided by the Organiser and comply with instructions and directions given by the officials and event marshals;
- Do not use a music player with headphones whilst cycling;
- Display the official event numbers provided at registration in the manner indicated in the event information booklet;
- Do not deviate from the official signed route of the Event;
- Abide by all Event rules and regulations. The participant will not be entitled to a refund of the entry if they are removed from the Event as a result of an infringement of these conditions or any such rules and regulations.
- Comply with the Highway Code at all times;
- Obey traffic officers and authorised marshals at all times; failure to do so will result in removal from the event;
- Understand that the following bike(s) are forbidden for use during the Event –electronic bikes of any kind, fixed gear bikes / singlespeeds / fixies (allowed with two independent brakes and a freehub), any attachment parts that endanger other riders (e.g. kick stands that stick out)
- PARTICIPANT DATA
- Participants agree that their personal information will be collected, stored and processed in a database for the purposes of administering the Event and in connection with any advertising mentioned in these terms and conditions. Such information will not be used for any other purpose other than as stated in these terms and conditions or as separately accepted by participants. If participants have separately agreed to receive communications from the Organiser or any charity associated with the Event then their personal data may be used for such purposes, including direct marketing. Please note that in processing the information in this way, the Organiser may disclose the information to other companies in its group or to third parties employed by the Organiser. The Organiser shall at all times comply with applicable Data Protection regulations currently in force in the UK.
- Specifically, participant data may be used for any of the following purposes:
- Medical information may be shared with medical personnel during the event if required. Medical information will be deleted within a reasonable timeframe following the completion of the Event.
- Contact details will be used by the Organiser to provide the participant with Event information by email and/or SMS messages.
- The participant acknowledges that the Organiser may contact them to invite registration for any future Organiser events.
- The Event photography partner will email participants after the Event regarding the purchase of participant photos from the Event if available.
- The participant agrees to inform the Organiser of any changes to the information supplied in their original online registration in order that they can be contacted for the reasons outlined above. The participant should amend his/her contact details through the online entry system as soon as changes are known; however, for any change in medical conditions, the participant must contact the Organiser on this email address directly – [email protected].
- Each participant is entitled to withdraw his/her consent to email and/or SMS communications from the Organiser and can do so at any time by writing to this address [email protected] or unsubscribing from the database
- Participants are entitled to delete all information from the Organiser’s database by writing to the same address [email protected]. In this situation the Organiser reserves the right to maintain information about individual sales transactions (not including credit card details) for record keeping.
- The Organiser reserves the right to refuse an applicant or participant entry to the Event in circumstances where that person either requests the deletion of such mandatory information from their participant profile, or provides false or incomplete information.
- GENERAL
- Participants hereby consent to participate in any reasonable publicity accompanying and resulting from the Event required on behalf of the Organiser and/or any other broadcast or media partners if so requested with no further recompense.
- The Organiser reserves the right and exclusive licence throughout the world to use participant imagery and associated data in connection with the production, marketing or sale of Event products or other marketing materials associated with the Organiser or Event partners.
- Participation in the Event does not confer any rights on the participant to use, alter, copy or otherwise deal with any of the brand symbols, trademarks, logos and/or intellectual property of the Event.
- Participants may not engage in any form of ‘ambush marketing (ambush marketing being understood as activity which utilises the publicity value of an event without having any official involvement or connection with the event) and shall not breach or infringe the rights of any sponsor or other party commercially associated with the Event, nor conduct unauthorised promotions or other commercial activity.
- The Organiser will not accept any responsibility for lost, delayed, incomplete, misdirected, mislaid, damaged or corrupted entries (due to whatever reason, including but not limited to malfunction of the Website), or entries that do not comply with these terms and conditions in any way.
- The Organiser accepts no responsibility for any damage, loss, liabilities (including direct, indirect, incidental, consequential or punitive damage) injury or disappointment incurred or suffered by a participant as a result of entering the Event, or not being able to enter into the Event. Nothing shall exclude the liability of the Organiser for fraud or for death or personal injury as a result of that party’s negligence.
- The Organiser reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Event with or without prior notice due to reasons outside their control or to amend or modify these terms and conditions at any time.
- The Organiser reserves the right to verify all participants.
- The Organiser reserves the right to amend these terms and conditions at any time by publishing an updated version on the Website. Any amendments will have immediate effect on publication unless otherwise specified.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive, remain in full force and effect.
- These terms and conditions are governed by Scots Law.
